    In order to use left-over visa numbers from EB1 and EB2-ROW, the PD cut-off for China and India must be locked. That's one of the reason why India's cut-off date has also moved.

    Hello All-

    Looks like they are monitoring this website and they have removed it now. There is no misunderstanding here, I copied and pasted it from their website so the question of mis-understanding doesn't arise.

    It doesn't matter because they would have sent that fax to the Senators before and the senators would have a copy of that fax.

    I am trying to write a strong letter to dis-credit that organization and their smear tactics and false propoganda. If nothing, then I would like to use the lettter posted by one of the posters here as a webfax and send the fax to the senators.

    Kindly, don't assume that they removed point #2 so they could be let off, what happens if they add something like this in the future and nobody notices it.

    Ideally, we should ask them to expose their membership accounts so that their lie of having 455000 volunteers is proved a blatant lie.

    Hello,
    I really think that if we just pursue aggressively on one and only item: Recapturing visa numbers, we would succeed.
    The moment you add anything to the bill that is to related to H1B revaildation inside US, eliminating per country quota limits or filing I485 when the dates are not current etc, the bill would be definitely doomed. Strictly no mention of anything else in the bill.

    Also most importantly the visa recapture efforts have to be concentrated for the Employment Based Categories ONLY. If we include the Family Based Category, we would lose the debate due to current high unemployment rate.

    I think that this is the only way to solve the retrogression issue -- to focus on only re-capturing visa numbers for use in Employment-Based Categories for educated foreign born professionals already employed in US.

    I sincerely hope that IV administrative team considers this item seriously and assign the highest priority and start fund raising immediately.

    By the way as for Mr.coopheal, I am not sure how updating my personal profile with all the filing dates accurately would matter at all for our discussion. Who gives a rat's ass about my filing dates anyway?.

    If you tired, why do you keep reading it? I think it is so irrational trying to admonish others.

    I am tired of listening to depressing economic news and beating dead horse on this forum. I know you are also tired, but trust me this doesn't help anyone. I can say this because I come from area dependent on free-falling auto-industry ... yeah I am from Detroit.

    Times may be tough, but we are making tougher for ourselves by re-hashing these bleak developments. Remember misery attracts misery!

    i believe the argument that this sudden jump was made to help eb2 china is pure hogwash.


    Scanning the FLC database, 5978 Indian Labor applicants with Level III/IV wage rates benefit with this jump, vs 761 Labor applicants from China.

    Assuming one labor approval generates 2.5 AOS applications, and dividing the total AOS applications by 2 (attrition, I-140 denials, EB3 cases etc), approx 15K Indians benefit, vs <2K people from China.

    Add to this 04/01/2004-03/27/2005 Indian applicants whose labor cases were adjudicated by Backlog Centers (approx 6000 Level III/IV applications , assuming same ball-park as 5853 similar India applicants certified in Fiscal year 2006), approx 7.5K more Indian�s will benefit.

    can we start mass web faxing USCIS for rule change?



    Now we are talking....first we need green signal from Core Team and request them to make fax for USCIS. Once we have fax, then we will fax this latter to USCIS same day. I hope once 6000 member fax this letter to USCIS same day then we will see some action from them too and we will be in media.

    I will also say that Core Team should sell this fax to its member for $10. If everymember pay $10 for this letter and if we are 6000 then it will be $ 60,000 for IV which will be very nice funds for IV.

    All we want from USCIS that allow us to file I-485 or allow us to file EAD or AP so we can have some freedom of travel and job change and it will also help USCIS to start name check ahead of time and that will also cut their processing time to process I-485.

    what do you guys think ??

    I think its not going to budge after this for 3 months or so, till they calculate all the applications received and do the math. Hopefully it will move forwards then, however (less likely) it can move backwards too ( I have seen strangest patterns with the bulletins)

    You will notice that there is not a single provision here that protects the rights of H1B workers and saves them from exploitation.

    There is not a single provision to punish employers who exploit H1Bs.

    Even with other immigration bills you will see there is not a single provision in these immigrtaion bills that punishes employers that hire illegal aliens. Thus all immigration laws being made never punish any US citizen breaking the law by employing an illegal alien or paying low salary or exploiting an H1B.

    Even with the current law, have you seen how many employers have been punished for employing illegal aliens. Do you know the penalty for getting caught. It is a mere $500 and nothing else. And you will be surprised to know that not even 100 employers have been fined last year. And only 2 H1B employers were punished after being sued by employees. No H1B employer was caught and punished for exploiting any employee. The laws are being made to favor US employers and to punish immigrants.

    I am surprised that nobody is noticing this.

    the laws are there , but only on the books, they don't fund them for enforcement.
    Also some laws are very week and needs to be changed.
    I think general american public is getting to know more about it as everyday
    passess with immigration debate. I think in the future if they pass any law
    it will come with heavy enforcement and also the provisions like hiking h1B and
    green card numbers, both will go hand in hand , there will be some controvercial provisions for both sides .

    As I said previously, just chill out.Let me give all you guys some advice whether you want it or not.You guys are just busy speculating about something which you guys have no idea about.As a result all you guys are doing is getting worked up and trust me this nonsense is not helping you one bit.

    If you are giving some factual help with how to file,procedures etc it is one thing, baseless speculation will get you nowhere.If you think I am not in the same boat as the majority of you-- you are mistaken.It is just that I try to stay positive while you guys keep whining.We all know the system is not working fairly for Indians even though we are bright,intelligent and law abiding folks.

    Sir, you are a senior and active IV member and i respect that totally.
    but EB3-I dates are rolling on nicely, they are already oct 01 they will cross well in 2002.
    in june 07, they were at june 03. then this mess happened in july and eb3-i was almost frozen over the entire year. now its starting to thaw..

    you must have already written to congressmen and called them up, also communicated with ombudsmen, i would say, please just wait and watch.
    i'm not eb3 but eb2 but i'd say allow older eb3 to get out of this rut.

    OK. May be my post was little misguiding. I never intended to distinguish EB3 and EB2 situations. We all are in same boat. Just need to counter the issue - one of the proposal was to do a flower campaign. I am not sure you were on forum when we did last time. It was a huge success. I am requesting to do it one more time!

    Exactly...If everyone registers, then we wouldnt need to estimate any ratios. Would we?

    Also even when people do register their case on this site, not many register their dependents cases.

    in FY08 we know for sure that EB2 Inida quota has been consumed. That gives a definite number of approvals to use for estimation. When i estimate that represents 6.75% of these cases (all cases upto Dec03), this ratio is a reasonable estimate of all the people who do not register.

    INFO PROVIDED FOR UK IS INCORRECT.

    Last year my wife (who is on H4) but with a valid US visa stamp on her passport was NOT allowed to board a Continental Airlines flight at Houston airport on her way to India. She was sent home even though she had valid US visa in passport as she did not have UK Transit visa.

    We tried pour level best to convince the ppl at the flight desk but they wouldnt let her check in because of transit visa issues. So please be very careful while transiting through London. We had to pay and reroute via Paris the next day.

    Ethnic cleansing is eliminating particular group of people while in civil war. Whatever happened in past in Rwanda could be called Ethnic Cleansing. Here Indians including me came for luxury life and better career though most of them available in India because here there is no availablity of skills. If US can get all the skills they need then there is no need for immigrants then if they reduce immigration that is not ethnic cleansing.
