    I would say 90 % in the same boat :p No sweat. They will do an immunization test. You could even get the vaccinations taken
    But some of those vaccinations require a 90 days period don't they? ( Like Hep-B if I am right, may be not!!!) :confused:

    Now I am working with attorney to file my I-140
    I have 3 Years BS Degree in Electronics From Andhra University + 1 Year BS Degree in Computer Specialization from Andhra University.

    Still I am kind of tense about my degree is considered as US equivalent degree. It accepted in H1-B, and EB-3 GC process. I am cross my figures until I get the decision from IO. I will give more updates later.

    What is the duration of your EAD ? (I mean for 1 yr/2yr ?) and Is it effective from the date of approval or from the date on expiration of your current EAD ?. Hopefully, this is your last ead as GC should be on your way soon.

    Thanks for your efforts.

    My suggestion is: those who have maxed out their 6 yrs on H-1B + have atleast crossed the labor and I-140 stage; should be automatically granted the green card.

    These are the people who are really stuck, because if their green card does not get approved, they have no option but to return. Also, if they lose their job they are out of options as they cannot seek another H1B extension or transfer.

    Typically, these people would have young children who were born here, and go to school here. These children sing the US national anthem and pledge allegience to the flag everyday at their school. Making these people wait and wait for their green cards helps no one. They are not taking anyones jobs, they are educated, civilized people. They have proved their usefulness to their companies and the society over the past 7~8 years.
    First of, they (kids) would not require a GC as the children born in here are citizens. Now if your reference is to GC for parents, it would look like the famous "anchor baby" situation, which was raised by illegals in the past. It didn't cut it for them. I do not think this argument will get us any where close, long story short, we cannot win playing emotional game given that kids can come back to US once they grow up. politically, rest of the reasons are personal choices made by us.

    Our strongest argument would be how can we help ease the situation that the country is in now?
    It should be about our contributions to this society/economy and providing competitiveness at global level.

    1. Can we move from CA to TX after I-485/EAD/AP is filed from California?

    You can move but are you changing employment? If yes, AC21 kicks in only after 180 days after filing 485, assuming 140 is approved.

    2. We do have a PO address is Texas now and have an apartment in CA for next 5 months.
    Do you recommend to use the Texas PO Box address instead of California Apartment address for USCIS I-485 application such that we can avoid the Change of Address with USCIS later?

    Check with lawyer, you can change the address later. But I think your move is too soon, so again check with lawyer.

    3. What are RISKS of moving from state to state during I-485 process? Did anyone do that in this forum?

    People have done this before but again check with lawyer, your move seems to be too soon

    I look at this bill in a different perspective:

    1. This will give the Indian IT companies an opportunity to move up the value chain. Rather than body shop its employees to clients...they can have all the IT work done at its development locations. Also they can fill americans for half of its US workforce.

    2. It will put an end to 100% H1b bodyshoppers who just make money without having any office and putting their employees onto client locations. These scrupulous bodyshops even dont pay on bench.

    The online application system gave me a date of Nov 27th. I go to consulate on the scheduled time to find that the office is closed. That's really bad. Luckily here in NYC, I went on the same day on Nov 27th and it was opened. The passport was sent to me by mail and received it in 10 days. I was surprised by the way the crowd was handled. I think it depends on the top person who is in-charge of the consulate.

    I have been using the 4 pack fuelbelt for the past 6 years. It has holders for 4 plastic bottles each of which hold 6ozs of fluid. There is a pouch in the front or back in which you can carry 2 or 3 power gel packs (for instant carbs/energy) and you can carry some Tylenol or Aleve if you need it. I clip my cell phone on to the belt itself along my sides or back.

    The 4 bottles contain enough fluid for me to run a half marathon. When I did the full marathon, I needed to replenish the bottles around mile 17 or so.

    I recommend carrying gatorade in the bottles as opposed to just water. Gatorade helps with electrolyte replenishment.

    Of course you can also carry your ID, some cash, house or car key in the pouch. I also purchased a shoe wallet, the clasp of which can be customized with your name, address, the name and cell phone for emergency situations. I usually carry my id, credit card, cash and 1 key in this shoe wallet. It clasps through your show laces with velcro, only about $10 bucks or so.

    No. It was changed in the middle of 2008. The DOS consulted with the Congress on this and came to the conclusion that there should be horizontal spillover before vertical. I don't want to go into whether this was right or wrong, fair or not. This is the current policy.

    You can see ample evidence in the annual visa allocation once you compare 2005/2006/2007/2008 allocations. EB3-ROW and EB3-ICMP benefited till 2007 because of vertical spillover and EB2-I & EB2-C have been the beneficiaries of the horizontal spillover policy since 2008.

    It is not the policy of DOS or USCIS to follow horizontal or vertical spill over. It is law. Both federal agencies (DOS and USCIS) has to obey the law by strictly following what INA section 201, 202 and 203 says, irrespective of how the law is unfair to any catagory. The law is very clear about spillover; it is horizontal. One has to read word by word in the law book to understand how the allocation of EB visas are made.

    If DOS properly followed the INA as amended by AC21 act in 2000, EB2-I never retrogressed since year 2005. EB2 I might have been always “current”. EB3 including ROW might have been much worst situation than now. EB3-IN would have beeen (always) be in disaster state since 2001. Though it is unfair to (EB3) many, this is what the law. Here is the historical events what happened in EB catagories.

    In later part of 1990s EB categories were retrogressed for IN, CH by about 2 years. When AC21 law passed in 2000, it did two very important things. One recapture of about 216,000 EB visas and it removed country quota in each EB category if excess visas available, in that category. That means it enforced horizontal spill over. In simple example, consider Mexico which is most subscribing country. Lets assume in a fiscal year, 40,000 Mexican are eligible for EB2 visa(and no other citizens in EB2), and millions of Mexican eligible for EB3 and in family based categories, still DOS should issue 40,000 (100% not 7%) EB2 visa to Mexicans irrespective of how much demand in other categories. Because of tons of backlogs in 485 (between 2000 and 2004), particularly in EB3, DOS issued about 185000 (out of 216000) to EB3. That’s why EB3 was current between 2000 and 2004. They simply ignored the EB2 demand by India and retrogressed in 2005, though total demand for EB2 less than the available pool of recaptured visas. Since the year 2007, they realized the mistake and now (since 2007) they are following correctly (though may not fair to EB3) the law. If they follow correctly the law, EB2-IN, Ch will become current soon. Till all EB2 become current, EB3 never see any spill over. Till EB3 –ROW become current, EB3 IN will not see any spill over. Till that point EB3-In will get only 2800 (7% od 40,000) EB3 visas per year.

    EB3 folks should thank to DOS for misallocation of EB visas between 2000 and 2006, particularly between 2004 and 2006. Now they are exactly following the law book. As title of this thred eays IV help or heavy lobbying is need to change the law to bring back vertical spillover, to ease the EB3-IN clog. They need to work hard.
