1. Asking employees to pay for H1 costs is not legal. It would be in violations of CFR.
2. That is also illegal. Employer cannot ask employee to pay for payroll taxes that the employer owes IRS, and too, when you are not even working. It would be an attempt to cover-up the violation of immigration law: Not paying on bench. The only alternative to all that is cancelling her H1 if she cannot find project and if they cannot pay her, but that again would cost money. My brother had horror stories when he was working in CA. His close friend cousin owns a company and he blindely trusted him. They forced my brother to sign a contract in the amount of $10000 if he leaves the company. He spent there for 6 months and found it horrible. He finally decided to leave the company and lost 1.5 month pay. Now he has the following issues.
1. He did not get his W2. And the company is not responding to his queries for his W2
2. He had to pay the tax on the amount which he did not received any money for 1.5 months
I hate desi companies as they take advantage of people and threaten them. Please share your ideas how can he proceed on his situation.

Gurus,
We have applied for 485 for four of our family members. Myself (Primary) and two kids got the welcome email on 06/25 and RFE email for my spouse application on 6/26. Haven't recvd any documents in mail to know the reason, but my questions to Gurus is
- How long will it take to get Card Ordered email after Welcome email. We havent recvd the welcome package in mail yet.
- Is there any relation between not getting Card Ordered email and RFE on my sopuse application.
- What could be the potential reason for RFE on my Spouse Application.

By the way, I also heard about the blast in Turkey, Iraq , a shoting in TN etc..
If everyone start following your advice, soon instead of asking for a green card, we would need to ask for a ration card.
I think this blog is stating fact. You did not hear 23 blasts in 24 hrs 50 killed. If not, then God Bless You. It is a need of hour for Hindus to wake up from there deep slumber.

I would be more than happy to help with whatever ideas you have on mind. Even if IV decides to create an exclusive EB3 fund, count me in for any monetary contribution.
Good to see someone from EB-2 advocating an exclusive EB-3 monetary fund...I think the spirit of this gesture speaks for the fact that we are in this together...let's translate into a "donor" status if possible...personally, I'm not bothered whether my donations go towards EB-2 or EB-3 and that should not be our long-term vision.

I dont think your issuse can be fixed even by attorney. You are not coming under any category to file Green Card. So prepare for yourself to go back and build your life back in canada.
