I am on my 9th year extension of my H1B. I have to leave to my home country at a short notice. I have H1B stamped on my passport. However it expires at the end of September. I may not be back until the first week of September.
I have already filed for my H1B extension and I am waiting for my Receipt notice.
Will there be any issue coming back into US when my visa stamped on my passport is valid for less than a month. I don't think my extension will be processed by then.
Anyone on this forum who has had similar experience in the past?

My employer filed the PERM with EB-2 in September 2007. It was audited in November. Still waiting. I have the fear I could get laid off. If this will happen before the Labor Department approval, and before the 1-year renezaw of my H1-B (exp. Sept.08), what will happen? Do I loose everything?

Hi friends,
Based on the predictions for the November 7th 2006 elections for the House, looks like the democrats will grab a considerable amount of seats,
viz - Democrats - around 228, Republicans - 205
What do you guys think based on this? I hope starting from January 2007, there should be some light.
Thinking ahead, We should work with the democrats, rather than republicans. Citizens of US, who immigrated from India should vote for Democrats and make them win this elections.

I think most the news that H1B's are turned back @POE are not ture. My wife just got her second H1B stamped at kolkotta embassy ( end of jan) and we came back through JFK on Feb 14th. I am on my second H1B. Not a single question was asked. Again Not a single question was asked for first time. Before they used to ask the name of the employer or ur position. We both are permanent employees for a big company ( think of iPhone) and done our MS here. based on my recent experience I do not see any problem with you.

Apart from H1 transfer your new company attorney may also need to file I-140 (successor in interest) in the new company name as well.

I am planning to go to Canada because my PR will be ready soon and I have to land to get my cards. I am not planning to stay there. Unfortunately I was born in one of those five countries which I can not go out and in with H1. With this US immigration Retro. I really don't like to lose my Canadian profile.
I am looking for find a way going around this issue and make sure I can come back to us without any problem.

Hi,
Address should be home address which in your friends case would be address in India.
Same applies for the home phone.
I believe you can put tentative travel date for his travel to US. This info is usually used to determine start date for validity of visa.
For last question, I had used name and contact info of graduate adviser/Department Head.

If you were subject to the cap for the last H-1B, you will not be subject again. The new employer would need to file a change of status for you, changing you from B-2 back to H-1B.

Hi all,
I got married in March 08. My wife is on H1 before marraige and working at Minenapolis but after the marraige she always stayed here(found a diff project) with me in DC. The mistake (i think) we didnt paid much attention the to the update on the address or the maritul status on paystubs and as of now both our paystubs show our older addresses and single status (as we thought we can file a joint return at the year end where we can do all adjustments). Now that my date is current and applying spouse as derivative will this raise any rfe (ofcourse i have the marraige doc)? As such iam not to bothered about the rfe per se as ours is a genuine marraige but iam worried whether these rfe will lead to extreme delays (i have seen cases) and whether anybody encountered this kind of scenario before pl post your experience.
Appreciate your opinions on this.

I HAVE H1 APPROVED TILL 04/10 BUT I ENTERED USA USING AP THIS YEAR SO MY UNDERSTANDING IS THAT I AM ON EAD NOW WITH SPONSORING EMPLOYER. I AM ASLO DOING PARTIME JOB IN OTHER FIELD ON EAD SINCE 01/08. Many folks who are in h1b their spouses in h4 will be aware that they will not receive any stimulus package and they would not have received in 2008. Becuase the spouse cannot get SSN and without SSN no stimulus package even for the h1 holder.
Now 2009 another stimulus package is going to come, can folks in the same boat join together and can we do something , bring some awareness of this issue , so that we are atleast eligible for stimulus package.

My current title is Software engineer and my company is promoting me to Senior Software Engineer. I am on H1 and have filed I-485 in last July and also have approved I-140. This is just the title change and my duties will be same.
(1) Does my company need to file H1 amendment to keep me on H1 or do I have to necessarily switch to EAD?
(2) Does anything changes with respect to GC process?
(3) Do I need to have any specific paper work from the my company that job duties are same?
Any help is greatly appreciated.

The minimum requirements for a particular job may, and often do differ from the minimum requirements for EB-2 classification. you can enter the country even a day before your visa expires, but the main thing here is the i-94 stamp where the immigration officer puts the duration of your stay...it will be till your visa expiry date. so it is better for you to have an approval for the extension so that you can get to stay till the expiry of your visa. do premium processing or something, you still have time...
