How to find out if you name check has been done/cleared.
Call USCIS customer service and insist that you want to speak to the immigration officer. Be persistent. IO will be able to tell you that. No need to waste time for Infopass.

It was just a minor adjustment to make room for expenses towards advocacy day.
Those who came to the advocacy event on April 4th,5th, like me, and saw the amount of money and efforts that go into reserving a conference room in a hotel next to the Capitol Hill for 4 days, printing out thousands of documents, inviting staffers/congressmen for meetings, arranging an elaborate reception for them, preparing advocacy packets for close to 400 meetings etc etc. I am amazed how IV is even able to afford the expenditures with the relatively small number donors that it has.
Kudos to IV-Core and the volunteers.
This needs to be advertised on the forums here or on the home page. Most people don't know what IV's expenses are.
A generic breakdown of costs, without going into specifics, would help members understand the expenses and provide some transparency.
It may even motivate new members to contribute more :)

I think the company should be filing the fees but lawyers fee for filing is not their liability. Hi Folks,
In many of the articles and forums I have read that applicants spent a lot of money on medical exams, lawyer fees, and so on towards the Employee based Green Card application.
Is it legal for one to spend money (out of one's own pocket) towards getting employee based green card ?
From what I had hear from my company's legal department was that they cannot take any money from me towards the green card application as it is not legal. Employee Based Green Card is for Employer's benefit and not employee's....though it eventually helps the employee -:)
Any comments ?

Hi All,
My friend whose PD is Dec 30 2004 - EB2 - Texas got his approval email. But he is already in india and travelling back this Oct 12th.
He already has valid Advanced Parole with him.
He wants to if there are any issues for him to enter at port of entry?
Any documents or print out of approval etc to be carried with him?
Does he needs to tell the office that his GC got approved?
Please help.

One question to all the smart people on this forum:
In the old system, if EB1, Eb2 and EB3 ROW are current then "all" unused visa from all the EB category be given to which category first:
a) EB1 Non Row
b) Eb2 Non Row
c) Eb3 Non Row
d) None of the above
Now second part of the question is :
If that category already has enough people in line, will the spillover to the next category will take place:
a) Yes
b) No
Not saying I am smart, far from it (otherwise, I probably would have been eligible for citizenship by now) but USCIS seemed to have given it to the oldest in the line regardless of the category.

He doesn't like Illegal immigrants "because they broke the law"
He says he likes Legal immigration, but then he curses every avenue for legal immigration under curent law.
1. He calls the diversity visa lottery the "great american giveaway" and has called for its abolition.
2. He calls family immigration "chain migration"
3. Finally, he calls employment-based immigrants as "stealing american jobs"
C'mon dude, its time to give up the pretense that you like immigrants!!
Too bad! they didn't deported his Granny when they came through Ellis Island.

immigration-law.com also raised general concern. may be our application is sitting in janitor rooms or some inaccessible cornor or lost. But some one in USCIS has to move a$$ to find out. We need AILA or powerful congressmen or senator's one letter and USCIS will act. That's a way, Govt Agency works. unless you make noise, nothing works. Baby also don't get milk unless cry.. :)

Thank you for contacting me and expressing concern regarding
immigration.
As you are aware, the massive influx of illegal aliens is one of the
most important issues confronting our nation. According to the Center for
Immigration Studies, there are at least 8 million illegal immigrants in
the United States. The United States Census Bureau estimates that the
illegal population in the United States grows by at least 500,000 per
year. All Americans have good reason to be concerned about this issue,
given the dynamics of assimilation, language and employment raised by
illegal immigration.
Amnesty proposals and guest worker permits are just some of the options
that Congress currently is considering. Another possibility is the H2B
Working Visa, which allows foreign nationals to enter the United States
temporarily to meet a one-time need in non-agricultural employment.
This is a good option, but I would not support H2B visas whose provisions
could not be enforced strictly and were not offset by immigration
cutbacks in some other area.
The problem with most of the options before us is that they do not deal
with the fundamental problem at hand: Millions of immigrants have
entered the country illegally. When we can establish firm, thorough and
effective enforcement measures we can better address the appropriate level
and need for H1 and L1 visas.
Border control is essential for our economic and physical security. I
appreciate your deep concern with this issue, and will keep your
thoughts in mind as Congress considers our legislative options.
Again, thank you for contacting me. Feel free to contact me again if I
might be of assistance in the future
----------
Indeed i approached him specifically for backlog reduction and other important features (similar to those in S1932 Sec8001) but i got the above response.
Anyway, one thing is very clear: We need to increase efforts in a much productive manner to clearly emphasise on legal immigration which is broken & SHALL NEVER be kept in the same tray of illegal immigration

Well suppose they reject your 485 for lack of Initial Evidence then you are in some trouble. The people who applied prior to new Memo was passed had there applications receipted even without EVL. What will happen after the Memo is passed ...can't say. I think EVL is considered Initial Evidence. Thats my guess.
If that's true, I hope they also accept the missing inital evidence, that is sent later, as long as the A# is provided.

Hello ajaysuri, Nil, saralayaar, trueguy and all those who support this idea,
I just happened to look at this thread and I give my 100% support to this idea.
I will mail the letter mentioned at page 10.
Please let me know what else I can do.
I think IV core has gone on long vacation or they already got their GCs.

I recently had to apply for a UK transit visa and the process went smooth as ever. I had to answer a lot of questions for both my wife and myself but after I have done that the process was easy. We just had to show up for finger printing just like for our 485s, send all the necessary documents to the correct address by (reliable) mail and just got emails that our visas have been approved. I have flown with BA before and their service is far better than any other airlines I have flown with before.

It is not popular to say so but I have this doubt too.
Currently at least there is no requirement to notify and you only need to prove you still have a similar job OFFER (not necessarily working) if and when there is an RFE.
Only good thing happened to us in last decade, as far as I can remember, is AC21 and concurrent filing.
All these immigration laws are designed to keep us indebted/bonded to the employer. They might see this as a liberating provision and try to chain us back. This may or may not happen, but just my paranoid reaction,.
Hope AC21 don't go away like labor substitution has. :(
That is naive... AC21 is not an administrative decision of USCIS... It is a law... AC21 = American Competitiveness in the 21st Century act!! It was passed by congress and the only body that can revoke it is congress.
USCIS cannot revoke AC21.. only congress can. Please dont be paranoid. The most USCIS can do is refuse to change their current stance on same/similar job.
Gurus, correct me if I am wrong.
