Did you choose the option 'your case is outside of the processing time'? Call them again and tell them it is delayed. SR (probably) was the key in my case.

StarSun...i'll help with both the tasks you mentioned. My lawyer already gives free advice in several LA univs so he might be interested in this.
My questions...says he is interested...what does he have to do to participate....is there a number to call for the conference call....or a special link where he has to go to join the chat? which thursday of the month is he needed...is this fixed or does it change every month?
To be honest i never visit the forum page unless i need to search for something and thats very rare....can we put up a link or an Icon with a tiny banner advertising the free lawyer phone call on the home page?

As for the lawyer conference calls, it has to be on the fourth Thursday of the month consistently. (This month, we ended up with 5 Thursdays, and therefore have no conf calls for the last 2). If we can have 4 free conference calls in a month - free on both ends - it is good.
When lawyers answers questions from our members, either through the conference calls or in the forums, their contact info will run on the top hand side of every IV page, giving visibility to immigration lawyers in a very targeted market. It is a mutually beneficial program for both members (getting free advice) and the lawyers (visibility).
Talk to your lawyer, find about his interests and let me know, I will follow up with him/her soon after the advocacy days in DC.

An idea:
Is it possible to recite the oath of citizenship in front of the senate en-masse? And maybe get some reporters to report the event..
Another, letter campaign, in which people will sign on the oath and snail mail to WH and also local senators
These might bring attention to us.. but feel free to knock it down (or ignore) if sounds absurd

that the current application processing range is 6-10 months after filing. Given the current economic conditions, it would be beneficial to see the application approved rather than worry about delays.

People like me are sitting on the fence. I wouldn't regret even if I don't get a GC at all...Sometimes, I feel that I am just waiting for any chance to go back to India... It is just the consideration of continuity in life for the family that really is driving me every day... It doesn't mean I will feel bad if I get the GC. The wait is simply not worth it. been living in multiple countries for the past 13 years... US is one another country for me.... That is just my case. I visit the forum and post in here because I can just monitor the situation... It is like monitoring my stocks, news on Libya,World cup, etc. Don't get me wrong guys... I wanted to share my facts.

My wife is eligible for fling for AOS right now , however she has already accepted a position with different salary and designation with the same employer and asked the employer to file a new H1 b, I dont believe its been filed yet. We never thought the dates would be current in our life time
We are thinking of refusiong the promotion offer, however the boss is willing to helo keep the new job waiting for her and continue her green card processing in the current designation
1. I know you can change jobs after 6 months of I-485 filing.at that point can she use the EAD to work at this new job or she can only port the EAD to a similar occupation?
2. Other scenario is then have to a future job offer for the category that she has applied to green card through either from the same employer or a different one.. and asking for a H-1 B for the job with a higher salary?
3. If the spouse derivative uses the EAD can the primary applicant stay on H-1 b Status without using her EAD or is it going to be considered as though she used her EAD and hence no longer in H-1B?

Now let�s go back to simple math: there are 140,000 immigrant visas available per fiscal year. 40,000 visa numbers are available at this time. The fiscal year runs from October 1st through September 30th. That means that in the first 9 months of the fiscal year, the Department of State and USCIS have managed to approve 100,000, which turns out to be 11,111 petitions per month.
During this period they approved applicants whose date was not current. These persons are getting GCs and there is a thread for such applicants. It is possible that there are 40K+ such persons. Hence, the following does not matter.
There is no possible way that USCIS and the Department of State are going to approve almost 4 times the number of permanent residencies in the month of July. The agencies do not have the time, nor do they have the manpower to approve 40,000 petitions within the next 30 days or so. That is the very reason why the Department of State official solely responsible for the priority dates felt pretty good about the availability of visa numbers throughout the month of July when he spoke to my colleagues from AILA.

EB3 ROW is at Jun 2004. But as per latest USCIS inventory, EB3 ROW pending 485's are around 48,000. Visa numbers available every year for EB3 is approximately 42k. If you deduct the backlogged EB3 countries (4x3000) visa numbers, the total comes down to 30k for EB3 ROW. So EB3 ROW should become current or atleast Jul 07 in another 1.5 years. If this is not going to happen, it means they are diverting the EB3 numbers to some other categories.

Immigration Voice: Announces Advocacy days in Washington DC in April.
Immigration Voice in its continued efforts to find legislative and administrative fixes is holding Advocacy Days in Washington DC on Monday, April 4th and Tuesday, April 5th.
2011 is a crucial year to get the fix needed to clear the backlogs and allow for our high skilled immigrants to get the relief needed. We need to capitalize on the opportunity to push for legislation now, as it is unlikely to have any favorable immigration bill to be brought for the next 2-3 years (Primary campaigns, Presidential campaigns will take priority).
IV’s vision is to hold more than 400 meetings with the legislator offices both in the House and the Senate. We will also be holding meetings with senior administration officials working on immigration issues. As a grassroots organization we need members from all across the country to register, participate in the advocacy event, bring awareness on our issues and seek a positive vote on our provisions from the legislators.
We aim to resolve this issue but we cannot do it alone and therefore it is imperative for everyone, and by that we mean EVERY ONE to participate in one way or the other. If you wanted to be a part of the past events but couldn’t, then now is your chance to make your voices heard and fight for a fair system and just process. Always remember, we are in United States at the invitation of our employers and our employers have filed our green card petitions in order to retain us. It is only fair and only just to ask for a system that achieves that objective without delays and without putting the immigrants in probationary limbo for 6-12 years. And it is your obligation to yourself and your family to stand up for your rights and ask Congress to legislate and fix the system so that it works the way it was originally intended to work.
Our previous efforts such as the June Advocacy 2010, September Advocacy and Rally 2007, Flower campaign, San Jose Rally, and many intermediary mini advocacy events in DC has allowed us to be one step closer to the goal. We need to make this upcoming event as a final push for reform. The President’s STOU address and feedback from Lawmaker meetings have provided us the encouragement to pursue this endeavor. As many of our members know, the efforts in our last advocacy days are consequential in how we are perceived by the lawmaker offices. IV calls upon members who participated previously to provide their input on the need for advocacy efforts and persuade many others to join in.
Immigration Voice will arrange for meetings, advocacy material, and other logistics necessary for all the events during the Advocacy Days. All you have to do is show up. We request our members to come in on Saturday, April 2nd for orientation and training. Please make arrangements to carpool (for driving distances), book airline tickets, and contact friends in DC/MD area to host you. IV will not sponsor your travel and stay for this event. We expect each one of you to take the initiative and stand up for yourself and your family and use this opportunity to ask lawmakers to act on high-skilled immigration issue.
Our efforts have to be of a massive scale, we need members from every State to participate in the event. To be successful we need more than 200 members attending meetings. We also need to know in advance on your attendance. Please take the time to talk to your employers, arrange for a leave of absence, and register for the event as soon as possible. Make every possible attempt to be in DC.
To conduct such an effort, IV also needs contributions. Our estimated cost is around $50,000 for the event. We need generous contributions from our members, especially from members who are unable to make it to the DC event. To be clear, all one time contributions starting from February 1st will be considered as a contribution to the advocacy event. All the recurring donations will continue to go towards Donor forum access. Our advocacy event costs will be on top of our regular costs and we need to pay for both.

People are loosing hope on CIR. For time being Pl. keep CIR aside. It is election year. we are not priority for congress in this election year. Why do not we ask for filing I485 even VISAs are not availble. If we get ability to file I485 tens of thousands of people will get relief.

Tough luck buddy. My case was current in June, but my attorney filed only on the last day of June and it reached on July 2nd. I was in a limbo till today. My PD is Dec 2002 and I have waited nearly 5 years. Its ok that everyone gets to file now. I-485 approval will be based on priority dates. So, don't worry. Hope you get to file in October 2007.

Yes, that is what the trend look like. There is probably another 5-10% fall in the works. Perhaps even more. I agree with you on that.
However, the million dollar question is how do you know the prices have actually bottomed one? Won't you go ahead and buy if its affordable, instead of wasting precious years which shorten the career span and deferring your decision? Its almost like deciding when to have your first child...well..almost. There is never really a good time, is there?
By affordable, I mean its around 'x' times your (dual) income, you have your green card and you are prepared to live in the US for next 5 years at least (even if there is any family emergency, you don't have any compulsion to sell off your assets and move to India for good). Now, 'x' may mean different for different people but generally people seem to agree x = 3. And I also agree with you that it might happen that american housing is always affordable. Yes, it might but for most middle class in SFO Bay area, when x was 7-10, it wasn't affordable at all!
I completely oppose folks like Slumdog doing something terribly rash (no gc, no prospect of gc within a year, single income with a baby, baby having some health issues and to top it all the burden of a heavy mortgage on the shoulders, god, I think his situation is simply awful...) but the way I read it is that these indeterminate immigration waits are making people throw caution to the winds.
And I don't agree with folks who feel that buying your house is like renting it out simply because it is mortgaged. There is big difference, eventually its get all paid off and you start actually owning it. Secondly, for a lot of people that they can sell it during their retirement and use the sale proceeds to cover the retirement life. There is very good chance real estate would have appreciated over long term. Of course, you are just interested in 'flipping' you are asking for big trouble.

There is never really a good time, is there? . Now housing is almost bottom and interest rate is so low now - but job market is terrible and you need to be careful about your job. Now let's say job market get's better in 2010 and you plan buy a house in 2011. you think you will have everything in order in 2011 . Make no mistake, you will another set of worry and things to take care.

I have seen approvals for May filers on IV.
Lots of people have posted about their EAD approvals in the GC thread.
I think TSC have started approving EAD filed in may. So, lets hope for the best. I hope this helps.

Out of 800,000 visa pending is it reasonable to say that a majority of the cases (maybe 400,000?) are cases with PD >=2005?? If so the number of pending cases with earlier PD dates (2001 to 2005) will be less. If you break this down by year, the number of pending cases by year does not seem much.. If they process by PD they should clear older cases like 2001 -2003 or even 2004 by end of 2008??
