I always travel by Asia route. China, Japan, Thailand, Singapore or Korea. For people on the pacific route this is the best option. The customer service is pretty good and they do not harass you for every petty things.
Fying from UK and France in particular feels like you are doing a favor to them. In this age of consumerism just stay away from British, Virgin, Air France and others and they will learn the lesson quickly. Iam very surprised why people take those routes. Just avoid them at all costs!

One would wish that life was as simple as this, i did not get any hits but i am stuck for the past 3 years and counting :)
BTW, the hits that FBI looks for is criminal or 'derogratory' as they call it, i think its just your luck, some get screwed some dont...
Collected from some other forum . Just google search your name combinations ( within quotes ).
For eg. if you have FirstName MiddleName LastName .
The search should be ( put within quotes )
"FirstName MiddleName"
"FirstName LastName"
"MiddleName LastName"
and all the reverse combinations.
If you get hits in 100s or 1000s , yeah you can wait 2 -3 years.
This is observed from the names of Indians.

a class action lawsuit ? if a lawsuit is expensive i am sure there are some lawyers who take on cases either probono or we all pool in our money and do something...

Finally got the CPO emails/texts today morning for both me and my wife.
Came to USA in 1996 on H1. Masters (F1) from 1999-2000.
All GC applications in EB2. Nationality : India.
Applied in Mid 2001 : company (think $15B!!!) went kaput.
Applied in Mid 2003 : I quit in mid-2005 - while labor pending.
Applied Nov 22, 2005 : Approved Aug 11, 2010.
Labor applied via PERM - approved in about 4 months.
I-140 applied soon after - approved in about 4 months.
I-485 applied during the July-August 2007.
Receipt Date: Aug 16, 2007
Notice Date: Oct 1, 2007
At NSC.
Quit in mid-2008 with 485/EAD, sent AC21.
Got RFE in Sep 2008 (missed the 2008 boat).
485 LUD stuck at 10/29/2008 forever until today.
Opened a SR on Aug 5th.
Took an infopass on Aug 6th - all I could get was, "your application is with an
Immigration Officer since Aug 2nd". Nothing else!
Don't know if either had an effect.
Didn't do anything beyond the above two.

USA in 1996 are now citizens. I have NO regrets at all. I took my own
path. Sometimes I used to think that if I had done the GC process
in 1998/1999 instead of quitting my full time job to do full time masters,
I might've gotten GC sooner. OR what if I had stuck with the 2003 application,
sure, it would've taken longer to get even the Labor cleared but I would
have gotten GC in probably 2007 - and worst case 2008. And heck, I would
have made an additional $150K (since the company got acquired by "as big
as it gets" tech company). OR what if I had chosen a very safe choice out
of masters [believe it or not, I got 12 offers back in 2000 - but then heck,
every body else got 12 offers as well]. OH btw, the full time masters ended
up costing me about $45K in credit card loans. So yeah...no point in contemplating
all the "coulda woulda shoulda"s in life.
As Nike says: Just do it.
I strongly believe it was because of the masters that I got the first 2000/2001 company, I got into the next job - and because of it to the next one and because
of that to the current one - where I am extremely happy and think
will over time come out very well off too.
At all times, I never compromised on my job. Took the job which offered
me the most challenge and allowed me to learn as much as possible while
working the smartest folks around. That I think was a great benefit - all
along - since that component of life (work) never bothered me. And was never
afraid of taking (apparent) risks either. To me they were calculated risks.
The 2002 company I joined, it was a small startup - I was employee number 20-something and was the only H1-B until we had about 150+ employees.
When I quit it was 450+ folks and was about 750+ when it was acquired.
The company I joined in 2008 (via AC21), was and still is a startup. When
I joined we were 8 employees and still now, remain lean-and-mean but
kicking some serious ass. (if I say so myself..pardon me). :)
The biggest hiccup as I think of it now was that my wife was not able
to work from 2003-2007. But the EAD in mid-2007 finally solved that
problem. Oh, I never hesitated traveling either : travel to Africa (three
countries) one year, and to Europe (three countries) one year and
Asia (two countries other than India) in one year.
Also purchased a home in 2009 (it was very tempting during the
2004-2006 times...but waited out for good).
So yeah...H1-B/EAD/AP are all handicaps - only if you convince yourself so.
A couple of times I had contemplated Canadian PR or really
moving there or to somewhere in Europe (and even Aus PR).
But pursued nothing mostly because I was lazy.
But all along my wife fully supported in everything I (we) did.
Be it change of jobs, other big decisions..what not.
So thankful to god for that.
Just a bit to go back in the way back machine.

Things repeat - old is new, new is old...repeat.
There were times when there was no online checking, no sms, no email notifications.
Six year h1-cap was strongly enforced. no concurrent 140/485. No one year extension of h1. No 3 year extenstions of h1 after 140. No 2 year EADs. No AC21. No priority date porting. I can go on....but a lot of stuff happened...happens.
If there is one thing I learned wrt immigration, it is do things ASAP. Never postpone anything at all. As much as possible get first in the queue.
A general piece of advice: Never reject an option you don't have. [this is more to do with folks who say, "I am only in year 1 in h1..I don't know if I need gc..let me see after 2-3 years.." - guess what einstein, it is easy to give up your gc after you get it, then to get it when you desperately need it.]

EB3-folks need some serious legislative help - please consider contributing a fraction of what you send for your immigration-lawyers and get something done. support IV.

I have a couple of issues guys and need your advise:
1. I have a valid H1b visa stamped on passport till June 2007. I and my spouse have EAD and AP as well. Upon my return from India in Dec 2006 the Immigration Officer at the POE did not let us use our h visas, H1 for me and H4 for my spouse and instead asked us to use AP to enter into USA and he stamped my AP and the I-94 showing my entrance as Parole and valid till Jan 22, 2007 ( My AP was valid till that date only). He said that I am not cancelling your h1. What does it mean? Am I no longer on H1 visa? What would happen after Jan 22, 2007 when my parole expires? I have filed for a new AP though but have not recieved it so far.
2. My and my spouse's EAD is expiring on Jan 22, 2007. We filed for the EADs in Nov and waiting for it. In the mean time we got a notice for finger prints. After the finger prints, our notices were stamped with the date on it. The stamp reads as "LIFE ACT PROCESSING STAMP" where as on all the previous occassions of finger printing, the stamp would read as " BIOMETRICS PROCESSING STAMP". Moreover as I have registered on line to check the status of my petitions, usually after the finger prints the date used to change when some thing happens to one's file like getting the finger printing done etc. but this time nothing changed and the date is showing up the same when I initially submitted my application.
Any Idea about this folks??? Time is running out for me.

take your i 485 application. There is a received date column and notice date column.
Date received is the date they received your application,notice date is the date they entered your application was entered into their system.
So, if someone with priority date of 08may2006 (eb2), but with a notice date of aug 30 2007 will get the green card earlier than someone with priority date of 20april2006 (eb2) with a notice date of sept 15.

According to Dobbs, those things serve the interests of big business but undermine the interests of the rest of us.
So wealthy corporations are out to crush middle-class Americans?
What nonsense. Those are the same Americans that corporations depend on to build their labor force, buy their stock and purchase their products. If these Americans don't do well, our economy falters. And that's not good for corporations, or anyone.
Nor is childish and irresponsible rhetoric good for public discourse or the country as a whole.
This is the world's healthiest economy, and a country with just 4.7 percent unemployment. Of course, there is anxiety, as there always is in a global economy with so many unknowns. As the world changes, it's only natural for Americans to feel some unease.

One more thing.
If you decide to apply multiple 485s with each other as dependents, then file just one first. Wait. Gets its A number and put that number in the other application. This way you will cover one pitfall of multiple filing. It will not cause confusion at USCIS end. Now This will not completely eliminate all risks in multiple filing. There have been cases in the past where when you inquire the status of one application, you will get the status of other. And if the PD of other is new, you can get stuck in a blackhole and will either have to wait for USCIS to sort it out or keep trying other ways to solve it. One of the reasons for delay (rightly put by Murthy) is -- when an application is adjudicated by a CIS officer, if the officer sees that there are other files open for the same individual, the officer will not adjudicate that application until that officer has all of the files in existence for that individual. This causes significant delays and confusion in adjudication.
Also do not apply EAD and AP on both. This is commonsense. But just mentioning it here in case..
I also researched the option of CP on one and regular 485 on other. While CP looks attractive, there are lot of risks. I have a big document on this. Overall I would not recommend this to anyone who wants to play safe.
Even multiple filing option should be pursued by critically evaluating your own situation. See how much you and your wife have secure jobs. How new are your PDS. What catagories do you belong to. Do not just apply because you have money to throw away. If throwing money gives you peace of mind, then by all means give it to the lawyers to file I485.

Is it legal for one to spend money (out of one's own pocket) towards getting employee based green card ?
From what I had hear from my company's legal department was that they cannot take any money from me towards the green card application as it is not legal. Employee Based Green Card is for Employer's benefit and not employee's....though it eventually helps the employee -:)
Any comments ?

Don't know if anyone noticed but Mr. Emilio's statement nowhere indicates any acknowledgement of the hardships caused by the fiasco. If he (and USCIS) knows about "flowers", I am sure USCIS knows about the scramble, hardships and frustration caused by the fiasco. A simple acknowledgement through something like " ....while we regret unintended consequences of following our internal procedures, we have made arrangements to forward the flowers to ..." would have demonstrated leadership or honesty of intent which I guess is in short supply

2) I didn't realize this until this evening when I mentioned the whole flower thing to my wife and she reminded me that government officials and agencies aren't meant to accept gifts from anyone. I believe this may have been considered a gift, or at least a grey area and perhaps they believed that discretion was the better part of valor.
I work for a government department, not as a State employee but as a vendor, and they aren�t allowed to accept anything from us that may be construed as a gift. Even when we have our annual golf days, ours are paid for by the vendor company but the State is forced to pay for themselves.

I believe this may have been considered a gift, or at least a grey area and perhaps they believed that discretion was the better part of valor.
I work for a government department, not as a State employee but as a vendor, and they aren�t allowed to accept anything from us that may be construed as a gift. Even when we have our annual golf days, ours are paid for by the vendor company but the State is forced to pay for themselves.

ok.. the letter is dated 4th august and did you get any information again that your case is assigned to a officer? if yes can you please tell how you contacted them? and after how many days?
I called the regular 1-800 number as soon as I got the response to the SR. Told the 1st Level that the statement in the response saying to wait till Visa is available seems to be wrong since the visas are currently available. The Level 1 agreed and transferred me to the Level 2. Level 2 confirmed that my case was assigned to IO on July 27. She said my case is probably delayed bcos of FP not being latest. Wonder if there is a way to trigger FP?

I guess we'll need to ADD to that number:
1. BEC stuck folks who could not file in July 07
2. PERM approvals starting August 07
to the 47,728. Plus multiply by 2.1( for dependents ). That'll give the total VISA numbers required for this category to make it Current.
If I have to guess-- (1) would be very less, may be 100-200 max
(2) around 5000 ( just a PUMA)
So, there are about 53000 EB2 I applications. and 2.1 * 53000 = 111300.
If we can create 111300, EB2 I visas then it'll be CURRENT. easy:)

I has also gone for Infopass appointment this morning. Office told me that my case has been under review since July 20, 2009.
So there is a chance that the case was approved sometime in the last 2 hours, but I dont see any updates anywhere. As mentioned in my previous post, I will call TSC again at 4 PM. I hope I can hear the same words from some other officer or I get an email or see online updates before that.

I totally support the blood donation idea. I am pretty sure, a blood donation drive would be front page news on American Red Cross web site also. It should send out a message that the GC is so important to us.
The actual collection of blood hopefully will be fully carried out by the American Red Cross.
