I don't know how much ombudsman will be helpful, but will try all options. My labour was approved in 2 months and I-140 in 18 days but it seems I485 is sturck for ever :mad:

This helps answer my question. I am a little unclear about promotions and whether that will qualify one for a new labor, etc. I personally am not planning to change anything at the moment. My promotion, etc is not being stalled because of my status. So I am OK. Thanks again for your answer.
Yes, promotions will qualify you and by promotion I mean a more Senior position, that needs more experience or an Advanced degree. Basically its just like you are applying for a NEW job altogether. You will need to file a new Labor and then I-140, but this time in EB2.

We are hearing from multiple sources that, on Monday or Tuesday of next week, State Department plans to issue a revised Visa Bulletin for July 2007. This revised Bulletin would retrogress some or all of the employment-based categories, very likely to the point of unavailable. Reports from AILA members about unusual levels and types of activities by USCIS indicate a particular push to adjudicate employment-based adjustments currently in the pipeline so as to exhaust visa numbers for fiscal year 2007.

I've been using Lingo for 3+ years, I called them to ask if they are aware(of course they are), rep said within a week they are coming up with a plan that's better than Vonage. unlimited calling to india and 100+ countries for $22.95. Plus i think they are going to include some free minutes every month that you can use to call india from your work or cell phone using a toll free or access # (just like you use Reliance).
Rep said you will receive an email in a week or so about the new offer/plan.
If you are already a Lingo customer I'd wait a week, Lingo has history of beating any competing plan.

If the Immigration Officer is kind enough you can ask if the Name Check is cleared. If he/she says No, you can ask him/her the date it was sent to the FBI.
thank you for your info on calling uscis and requesting namecheck info.... i called them today, asked about FP 1 and if it had been sent out... they told me to wait for FP notice but they were able to check for name check info..... name check has passed..... 485 RD July 16 2007... thanks again for uscis contact info

When you want to join vonage or customer you will have good exp. Try to cancel or select the option to cancel and see.
I signed up online after one my friend referred me to this plan but unfortunately I have not used their referral link. I called customer service after getting my phone and told them my friend's number and they are saying that since I did not go through the right link, we both won't get the $49 until after I complete the 3 months. And I won't get it if I forget to call them after 3 months. I am wondering if I should cancel and send them back the router and order online through the referral link.

How come total pre-adjudicated in the chart is exactly equal to total I-485 in the pdf ?
What exactly total in chart tool means ?
You might be convinced that you are right but stating that others are asking stupid questions is little too far.
Its not that I think I am smarter or have any additional insight...but I take things at face value. Of course the total number of pending cases in the chart and in the PDF should match - they both are exactly what they say they are "PENDING EMPLOYMENT BASED I-485 cases" If that's what the report title says, that's exactly what it means. No point in over-analyzing if this is just for pre-adjudicated or only primary applications etc....
I say stupid questions because people still ask "Does the PDF report contain numbers for dependents or only for primary applicants" - so you are telling me that this is not clear from the PDF report??

Finallly, my online status changed from "Initial review" -> "Document production" and also got email from Senator's office that my case is approved.
I think I got it....but not 100% sure yet...no approval emails yet... or no other proof.

Please find the details of how we complaint to our client management regarding L1 violation ....(for some of you guys who are interested in educating uer clients)
Step 1. Collect the email id of uer CEO and 8-10 executive managers, make sure that your groups CIO/CTO s email ids are included, get the email id of HR Head/Legal Dept/Immigration Dept of your client (CC them in the email).
Step 2. Create an anonymous Id with something like "Against Fruad"
Step 3. Formulate the email as given below
Subject: Fradulant Activity by Vendor - CTZ Tech Solutions ...For Eg.:-)
First Paragraph: What the Fraud/Violation Is?:
Mention the L-1B violation by these companies and how these resources are legally prohibited from working on staff augmentation assignments, mention the L1 reform act of 2004, provide the link to USCIS website and attach the .pdf file with L1 reform act. Mention the list of employees at the bottom of the email.
Second Pargaraph: Why They Do This?: Key points .. NO wage restrictions, NO numerical limitation and mention the H1 visa lottery in 2006,07,08 etc. NEVER talk abt corporate greed in this whole email (hope u got why!).
Third Paragraph: How they do this?: Mention about the petition which has to do nothing the current project they work on and the visa interview where these guys tell abt someother projects and clearly mention how they gets deployed to projects where they don't have eligibility to work and skills they cannot be utilized for.
Fourth Paragraph: How to Prevent this: (To show that you are sending this to resolve an issue and not to complicate one) ... mention about how easily each hiring manager can avoid this by setting visa criterion for all jobs including contract and temporary jobs.. once criterion is set by hiring managers these vendors cannot violate the same. VO doesnt keep your passport if a via not issued at the time of the interview . He gives it back after the interview. Once you receive the email , you have to go the VFS office and then had in the passport.
I guess this is specific to Mumbai only .. for all other post in India, the consulate/embassy keeps the PP ...
Am planning to visit India during Apr-May time and wondering how to take care of the situation ... seems DHS/DOS/DOL/USCIS/Who ever implemented a process without having the proper infrastructure in place ... and again they take us for granted ... with limited number of vacation days in hand if we stuck because of the PIMS, this will be a difficult situation to handle ..
How the Kolkata consulate doing on this aspect ... can anyway share their experience there ...
