If someone is responsible for the current state of affairs in the H1B area , It is Indian firms . The H1B1 was started in 'GOOD FAITH ' by United States to help people from "all over the world" to come in and work in the US , but large Indian IT houses have overexploited these loopholes so much that we are currently in this sorry state of affairs . In their greed for higher and higher profits(every Indian firm hits 30% profits every quarter ) they have spoiled a perfectly working program a few years ago to such a state that now getting an H1B has got less nothing to do with talent but has become like buying a supperlotto ticket .Below is a very good article from the "Economic Policy Institute " that highlights the fact that 2 well known Indian firms have single handedly lapped up 65% of H1B visas last year and have applied for just 69 green cards . Thats a GC application rate of 0.0004%. i Cannot help agree with the facts in this article. I totally agree that firms like these which abuse the system ought to be severely punished and blacklisted, so that geniunine US companies can get their required workers , when they need them . The link is as below.

I filed my I-140 in July 07, I-485 in August with PD of June 07(EB3 India). Perhaps there may be many more like me with very recent PDs. Given that it is going to be a very long wait for getting GC, what should be a good approach for me? Use EAD after I-140 is approved (AC21 would be in place by that time) to make the most of the waiting time or play it extremely safe and stay with the current employer till GC is received?
there is a third option. After 140 is approved, you may change employers (assuming 180 days since 485 filing are up) but still maintain H1 status by doing an H1 transfer. AC21 does not require the use of EAD. It is equally possible to invoke AC21 while still maintaining H1 status. Of course, it may be easier to use EAD for employers that do not want to sponsor H1 since you already have an EAD.

It is encouraging to know that your case is assigned to an officer that you raised an SR on Aug 3rd. An SR was raised for me on Aug 3rd as well and the customer service rep mentioned that my case is also assigned to an officer...
So, Will Aug 18th be "the day" to look for ?? :D
Good luck to you and let us keep all of our friends posted on the same
Cheers
That would seem to be true. I am hoping that our cases will be approved even before that. I have exhausted everything that I can do except for Ombudsman - which I want to keep as last resort.

I guess, it is the 13th ....such an unlucky number..Just kidding..When all of us are so anxious about this..I can't even begin to imagine what our EB-3 friends are going through. Especially to whose who have been waiting for almost a decade (or more) and still stuck..
I guess, we should take all this news with a pinch of salt..
Cheers
It looks like November 2005, Jan 2006 and Feb 2006 priority dates are somehow lumped together. Of course mine is December and far be it from being even considered :)
gbof and anilkumar... I think this is the hardest wait for us. I hope the two of you and all others get approved soon enough.

This is Great. You dont have to run the entire 10K. You can run part of it and walk the rest. I do that a lot.
This is a link to other races in the DC area: I have never run a race; so I plan on running one of the 5K races in May or June and maybe try one of the 10K races in August. I am sure there are other races abound in summer. If there are others who are apprehensive about running the 10miler (like me).........you might want to try doing something similar.

screw you oscarzumaran. The very fact that you are so knowledgeable about fake degrees and fake experience tells me that you have good experience doing such things. And whether I port or not is none of your f**** business. I am sure your posts are being watched by IV admins and its only a matter of time you will be thrown where you always belong - DIRTY GUTTER..
eb3retro, no need to get nasty here. We all know that you probably have fake degrees and fake experience that you used to get to the US. Being in EB3 for so long without porting to EB2 proves it. You are worried you will get caught in case you port...aren't you? We get it. I have seen the pathetic English you write. And do you work for an uncle who is keeping your status alive? Surprised how I found out?
So, whose truth came out now? ;)

there was a rencent drive undertaken by IV which involved getting a list from USCIS (or some other authority) about where the visa #s are being used, right ?
Perhaps something to do with collecting money from the requstor..
Basically, USCIS sent letters to a few folks asking them to pay 5000$ or so to get the list as it involved some programming ?
Where is that ? does anyone know ?
the visa bulletin is just ...what do you say....
You can still contribute to that cause......

I have been continuously requesting in my previous postings that CORE Team should take up the issue of sufferings of children who have turned 21 and who could not file 485 applications due to visa retrogression. I do appreciate that this may not impact a large number of our members and CORE is committing its recourses for a much wider issue of over all visa number increase. However, getting visa number increased is a big effort and in current environment may not be achieved. However, getting CSPA amended may not e that much a big deal and if CORE team starts working on it, we may see positive result. As such, I again request CORE team members to take up this issue. I am prepared to lend my support in whatever way I can and I am sure there would be many other members who will be willing to do the same.

I googled to find any cases similar to the one I have now, by no luck.
My wife was out of status for more than 6 months while she was on H1-b by not working. To put her back on status, my attorney advised to make her go out of the country and come back on H4 visa. Her status now is H4 and has maintained it since the last entry to US. I have maintained my H1-B status since 3 years and got paid for every day.
Is it possible, my I-485 is approved (primary applicant) and her I-485 denied (dependent) due to her prior out-of-status on H1-B? Her current status as mentioned in the I-485 forms is H4.
Please advice.
Thanks.

As some of you know, I have been working with news media, government leaders, and immigration lawyers over the past year because of the stimulus debacle. As a result, I have developed some strong contacts in government. I will be meeting some congressional immigration staffers in the next few days and I have developed a list of issues to discuss. If you want to post your own issues, feel free to do so in this thread and I will add them to the list. These are the same people who helped get the last stimulus bill changed in our favor, so they do have influence.
PLEASE be brief - bullet points would be good.
Also links to articles to support your concerns are welcome. I will put together a package to hand out at the meeting.
I thought of posting a poll on this thread, but decided it would be better to leave the discussion open ended.
WOW!!.. whats a response.. Keep going..
At the same time, keep trying yourselves also by whatever means possible. Totoro is trying so hard for us, and even if we have five guys like this with such contacts, yet the efforts are not sufficient. We must also help ourselves by our individual efforts like writing to change.gov etc.. Lets not put all the 6 pages of ideas in just one basket. Since there is difference between eggs and ideas, duplicate the ideas and put them in other ways also, apart from just here.
Totoro,
Thanks for your efforts.
We all missed one point. Can you please update your profile.
Are Canadians also backlogged in this mess.
And you said "As some of you know...." . Were you try in these lines before too.

Says who?
And although I am the last one to engage in US-degree versus non-US degree and Masters Versus Non-Masters fueds, I am tempted to say that US masters or US degree isnt worth a bucket of warm spit when the market is bad.
When the market is really bad, like it was in 2001 and 2002, I have seen many Masters degree holders pack up and throw in the towel and I have seen many individuals with degrees from private Tier 3 university from India survive just fine in an environment where there were 80 resumes for each IT job. The US masters degree holders, particularly with computer masters degrees with their courses in useless subjects like "assembly level programming" and their binary math didnt do squat for them while looking for jobs during recession times and could not stand competition from bachelor's degree holders from Tier 3 university from India who had done 6 month course in NIIT.
Unintentional, might be, but you did ruffle this topic of US Master's vs US Non-Master's with this rather sad comment (warm spit!). I dont want to go much further into this either but talking about something that you obviously dont know (useless subjects 'assembly language programming'), you havent added any valule addition here either. (Just FYI, even during peak recession, ppl with ALP skills were really very few because most of the direct recruits from '6 month NIIT courses' werent upto system level programming).
And btw, if think that a 6 month course in NIIT with a degree in tier 3 university is going to help get a job during times of recession, then i dont know what to tell you.
Yes, i do have an MS degree from the US and i did suffer lay-off during recession - bounce back, i did really quickly while i saw few ppl that only had '6 month courses from NIIT' suffer for long times without a job because all they had to offer was that...their six month experience at NIIT!!
Btw, i do appreciate all the work that you do and all your postings too, but i felt that i had to give a riposte to something that i find insinuating and written without a whole lot of thought....

I dont buy the argument that only India and China produce the brightest people who are willing to work here in U.S. There are just as many people from Europe and the rest of the world who are just as qualified and who would want to work in the U.S. The problem starts with the H1-B visas, where most of them are taken by these Indian IT consulting companies. Correct me if Im wrong, but I dont think these IT companies hire non-Indian workers. There are many qualified people from the rest of the world who are willing to work here in U.S, but cant because the majority of the H1-B visas is going to Indians and Chinese nationals. Perhaps, there should be a per-country quota at the H1-B level. I dont think there is anything wrong with the current country quota; if some countries dont use their quotas then these quotas roll into the countries that have higher demand.
I second that. As long as there is widespread abuse -- large numbers of Indian body-shops and consulting companies that import people by the thousands -- and as long as that skews the numbers, there should also be checks and balances -- per-country limits. Per-country limits and diversity argument are a good way to restore the balance and offset for the abuse.
I'm really tired of hearing people saying that diversity is for FB or for DV visa. What make FB immigration a better candidate for diversity?!? Absolutely nothing. The law provides for diversity in ALL immigration categories -- EB, FB, DV, etc., and there is nothing discriminatory about it. The discrimination comes from companies that abuse the system, import thousands of consulting workers with 3-year degrees who don't really have jobs but sit on the bench for 8-10 months at a time (something that's explicitly disallowed by H-1B law), and then apply for I-140/I-485 going through an unending sequence of RFE's, NOIDs, MTR's, etc. and slowing the system to a crawl. Now these people want the whole world to suffer with them by "distributing" the pain. Why?
If somebody takes care of this abuse, the remaining really qualified Indian/Chinese workers who really deserve to be here will find that they won't need a separate category because there won't be any severe backlogs for their countries.

I am sure a lot of skilled people like us, especially immigrants, have a strong desire to work hard, smart and make money. Thanks for taking the initiative.
1. Do you plan to buy stocks directly from the companies or use a broker like TdAmeritrade, Charles Swab etc.,
I use a couple of brokers TDM, SOGOTRADE and Scottrade. All have their own benefits , But to buy and sell I use TDM/SOGO . Lot of good info/charts/filters etc on Scott and TDM
2. Is there going to be one trading style like you mentioned about Pattern Day Trading.
There are n number of trading styles , we can discuss afew and you can choose what suits you best
3. Is there a plan to conduct some series of tutorials or sort and practice at our own risk without supervision
I strongly recommend reading and rereading as much as you can about basic fundamentals of trading in general ........Ask tons of questions and evaluate answers.
GOOGLE GOD
DO NOT JUMP BLINDLY into any kind of trading
4. Will there be any local, phone or online meet
Well if there is enough Momentum we can have a tele con or video con where we can share desktop screens for learning
5. Above all how is it going to BENEFIT IV.
Lot of ways you can do it....One way is to Pledge a certain % of your trade earning etc
Its our IV its our calling
You got me glued to this now.
